These Terms of Service ("Terms") govern your use of Postia and our website at https://www.getpostia.com (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree with these Terms, do not use the Service.

1. Who We Are

The Service is operated by Postia ("Postia", "we", "us", "our").

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Account Registration

To access certain features, you may need to create an account.

You agree to:

  • Provide accurate and complete information
  • Keep your login details confidential
  • Be responsible for all activity under your account
  • Notify us immediately of any unauthorised use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of the Service

Postia is a SaaS platform that helps Etsy and digital-product sellers create and schedule Pinterest pins and related content.

Key features include:

  • Generating suggested pin titles, descriptions, and SEO keywords
  • Creating and managing Pinterest pins using your product data
  • Scheduling pins to boards you select
  • Generating optional SEO blog post drafts from product URLs

The exact features may change over time as we improve the Service.

5. Pinterest & Third-Party Services

The Service may integrate with third-party platforms such as Pinterest and others.

  • Your use of any third-party platform is governed by that platform's own terms and policies (e.g., Pinterest Terms of Service)
  • We do not control these platforms and are not responsible for their content, rules, or downtime
  • By connecting your Pinterest account, you authorise us to access and use information from Pinterest as described in our Privacy Policy

We may modify or discontinue integrations at any time.

6. Your Responsibilities

You agree that you will:

  • Use the Service only for lawful purposes
  • Comply with all applicable laws and regulations
  • Comply with Pinterest's policies and posting rules
  • Only upload or use content you have the right to use
  • Not infringe on intellectual property, privacy, or other rights
  • Not use the Service to harass, threaten, or defame others
  • Not send spam, scams, or misleading content
  • Not attempt to reverse engineer, hack, or disrupt the Service

We may suspend or terminate your access if we suspect abusive or unlawful use.

7. Content & Ownership

You retain ownership of any content you upload or generate using the Service (product images, texts, pins, blog posts).

By using the Service, you grant Postia a limited, non-exclusive, worldwide licence to:

  • Host, process, and display your content
  • Create derivative works such as pin text and blog drafts
  • Publish content to Pinterest on your behalf, only when you explicitly approve and schedule it

This licence exists solely to operate, improve, and provide the Service.

8. Plans, Billing & Trials

If you choose a paid plan:

  • You agree to pay the fees associated with that plan
  • Fees are billed in advance (monthly or annually, depending on your selection)
  • All fees are non-refundable except where required by law or explicitly stated

We may offer free trials, free tiers, or promotional pricing. We reserve the right to modify or cancel such offers at any time.

We may change our pricing with reasonable notice. Any changes will not retroactively affect your current billing period.

9. Cancellation & Termination

You may cancel your subscription at any time via your account settings or by contacting support@getpostia.com. Cancellation will stop future renewals; your current paid period will usually remain active until its end.

We may suspend or terminate your access if:

  • You breach these Terms
  • We are required to do so by law or a third-party platform
  • There is evidence of abuse, spam, or harmful behaviour

Upon termination, your access to the Service may end, but we may retain certain data as described in the Privacy Policy.

10. Intellectual Property

All rights, title, and interest in and to the Service (including the website, design, code, logos, and trademarks) are owned by Postia or our licensors.

You may not:

  • Copy, modify, or reverse engineer any part of the Service
  • Use Postia's trademarks or branding without our permission

11. Disclaimers

The Service is provided on an "as is" and "as available" basis.

We do not guarantee that:

  • The Service will be uninterrupted, error-free, or secure
  • You will achieve specific results (e.g., increased sales or traffic)
  • Integrations (like Pinterest) will always be available or unchanged

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Postia will not be liable for any indirect, incidental, special, or consequential damages, loss of profits, loss of data, or business interruption arising from your use of the Service
  • Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid to us in the 3 months preceding the claim, or £50 if you are using the free version

Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, or any liability which cannot be excluded under applicable law.

13. Indemnity

You agree to indemnify and hold Postia harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your infringement of any rights of a third party

14. Changes to the Service or Terms

We may update the Service and these Terms from time to time. If we make material changes, we will provide notice (for example, by email or in-app notification).

Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules.

Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of England and Wales.
